1. Acceptance of Terms

By downloading, accessing, or using the BrackIt mobile application and website located at getbrackit.com (collectively, the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please discontinue your use of the Service immediately.

2. Description of Service

BrackIt provides a platform for organizing and managing sports tournaments. The Service allows users to create brackets, generate match schedules, track live scores, and manage venue locations.

3. User Accounts and Guest Mode

• Account Creation: You may create an account using your email address to sync and save your tournament data. You are responsible for maintaining the confidentiality of your account credentials.

• Guest Mode: BrackIt offers a guest mode using anonymous authentication. If you choose to use the app as a guest, a temporary anonymous profile is created. If you uninstall the app or clear your data before creating a full account, your guest data (including schedules and scores) may be permanently lost. We are not liable for data lost while operating in Guest Mode.

4. User-Generated Content and Conduct

When you use BrackIt, you will input data including, but not limited to, tournament names, team names, match locations, and scores ("User Content").

• Your Responsibility: You retain ownership of your User Content, but you are solely responsible for its accuracy and legality.

• Prohibited Conduct: You agree not to use the Service to publish content that is offensive, discriminatory, unlawful, or violates the intellectual property rights of others. We reserve the right, but not the obligation, to remove or edit any User Content that violates these Terms or is otherwise objectionable at our sole discretion.

5. Subscriptions and Billing (BrackIt Pro)

Certain advanced features of the Service (such as advanced scheduling logic and unlimited tournaments) are available via premium subscriptions ("BrackIt Pro").

• Payments: Payments are processed securely through the Apple App Store or Google Play Store.

• Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

  
  

  
  

• Cancellation: You may manage your subscription and turn off auto-renewal by going to your Apple ID or Google Play Account Settings after purchase. Deleting your BrackIt account or uninstalling the app does not automatically cancel your subscription.

  
  

  
  

6. Intellectual Property

All original content, features, and functionality of the Service—including the scheduling algorithms, UI/UX design, and the BrackIt logo—are owned by BrackIt and are protected by international copyright, trademark, and intellectual property laws. You may not copy, modify, or distribute our proprietary elements without explicit permission.

7. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. While we strive to provide accurate scheduling and scoring tools, BrackIt makes no warranties, express or implied, regarding the reliability, accuracy, or availability of the Service. We do not guarantee that the Service will be error-free or uninterrupted.

8. Limitation of Liability

To the maximum extent permitted by applicable law, BrackIt shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of data, loss of revenue, or scheduling errors resulting from the use or inability to use the Service.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in New York.

10. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect via an in-app notification or email. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised Terms.
